In 2013, Shanghai Intellectual Property Administration strengthened intellectual property protection, to create a favorable environment for intellectual property protection around the city.
Firstly, they implemented special projects on intellectual property law enforcement and rights protection, organized the intellectual property bureaus of districts and counties to develop 22 patent administrative law enforcement and inspection activities, and inspected 63 business units and over 200,000 kinds of commodities, issuing the rectification notice for commodities with nonconforming patent identification. They developed pilot work for the intellectual property protection of professional markets such as First Drug Store, Hang Lung Plaza，Leiyunshang Drug Town and so on. They also launched a strong pilot community to combat the illegal behavior of infringement of intellectual property rights in Hunan Road of Xuhui District and Wujiaochang Street of Yangpu District.
The second was to enhance patent case hearings. This year, 120 various patent cases were registered and accepted, a year-on-year growth of 73.9 percent compared with 2012, and settled 118 cases, including 98 cases about registered and mediated patent disputes, a year-on-year growth of 78.2 percent compared with 2012, settling 96 cases. They registered, investigated and treated 22 fake patent cases and settled 22 cases.
The third was reinforcement of intellectual property protection within exhibitions, and revised stipulations of intellectual property terms in Administrative Measures for Exhibition Fair in Shanghai City. They appointed 78 patent administrative law enforcement personnel and 166 patent agents to enter 35 major international exhibitions, including the annual Industrial Fair and East China Fair, and they accepted and heard 278 dispute complaints concerning patent infringement on the scene.
The fourth was to intensify intellectual property rights protection services, Shanghai Intellectual Property Expertise Center of Judicature completed intellectual property judicial authentication for 17 cases and accepted 11 registered creative design cases. The State Intellectual Property Aid (Shanghai) Center provided eight aid application projects with rights protection services. In Shanghai, “12330” is the Shanghai intellectual property rights protection aid and complaint hotline that accepted and treated 604 calls, and accepted and transferred 20 complaint cases. The Patent Review Commission of the State Intellectual Property Office heard two patent invalidation announcement cases in Shanghai.
The fifth was to make proper intellectual property protection for the first China (Shanghai) International Technology Fair, formulating the “Shanghai Fair” patent dispute treatment principle, patent dispute complaints and treatment flow. They added in the exhibitors’ “Intellectual Property Commitment Letter” in the exhibition contract and exhibition guide. They connected the intellectual property protection consulting hotline and set up the intellectual property service station to provide complaints, consultations, retrieval and filing services, and they realized their “zero intellectual property complaint ” goal at the first Shanghai Fair.
The sixth was to promote the commitment of “selling authentic brands and authentic products and protecting intellectual property” within the business system. They attracted 239 units and 4,313 stores to participate in the activity.
