Standard of compensation for disability caused by traffic accidents in China

Chinese law shall be applied in the trial of such cases in China. According to the General Principles of the Civil Law, Tort Liability Law and Interpretation of the Supreme People's Court of Some Issues Concerning the Application of Law for the Trial of Cases on Compensation for Personal Injury, the compensation include medical expenses, lost income, health care expenses, hospital food subsidies fees, transportation fees, appraisal fees, disability compensation, rehabilitation and follow-up treatment costs, disability aids charges, dependents living expenses, mental solatium and other reasonable expenses.

In accordance with Interpretation of the Supreme People's Court of Some Issues Concerning the Application of Law for the Trial of Cases on Compensation for Personal Injury, the amount of personal injury compensation to foreigners and stateless persons shall be calculated according to the relevant standard for urban residents.
